01Who I Am / Kim jestem

RepDrop is developed and operated by:

I am an independent developer. "Działalność nierejestrowana" is a form of small-scale solo activity permitted under Polish law (Art. 5 of the Act on Entrepreneurs' Law - Ustawa Prawo przedsiębiorców) that does not require registration in CEIDG.

Jestem niezależnym deweloperem prowadzącym działalność nierejestrowaną pod nazwą bypop. Kontakt: hello@bypop.dev.

02Acceptance of Terms / Akceptacja Regulaminu

By downloading, installing, or using RepDrop ("the App"), you agree to be bound by these Terms of Service ("Terms") and the Privacy Policy. If you do not agree, please do not use the App.

Korzystając z aplikacji, akceptujesz niniejszy Regulamin oraz Politykę Prywatności.

03Eligibility / Wiek użytkowników

You must be at least 16 years old (Poland and EU - minimum digital consent age) or at least 13 years old (USA) to use the App. By using the App you confirm you meet this requirement.

Korzystanie z aplikacji wymaga ukończenia co najmniej 16 lat (Polska / UE) lub 13 lat (USA).

04Description of the App / Opis aplikacji

RepDrop is a personal fitness tracking app for iOS and Android. It lets you set rep-based exercise challenges, track movement breaks throughout the day, and receive local reminders. A free tier and an optional Pro subscription are available.

I reserve the right to change, update, or discontinue any feature of the App at any time.

05Health and Fitness Disclaimer / Zastrzeżenie zdrowotne

• Consult a doctor or physiotherapist before starting any new exercise programme, especially if you have health conditions, injuries, or are pregnant.
• The exercises, challenges, and break activities are for general personal wellness only.
• I am not liable for any injury or harm resulting from use of the App.
• If you feel pain, dizziness, or chest discomfort during exercise, stop immediately and seek medical help.

Aplikacja nie jest urządzeniem medycznym. Przed rozpoczęciem ćwiczeń skonsultuj się z lekarzem. Nie ponoszę odpowiedzialności za kontuzje.

06Pro Subscription / Subskrypcja Pro

6.1 What Pro Includes

6.2 Price and Billing / Cena i rozliczenie

Free trial: RepDrop Pro includes a 7-day free trial for new subscribers who have not previously subscribed to RepDrop Pro on the same Apple ID or Google Account. The trial begins immediately upon confirmation of the subscription. No charge is made during the trial period. If you do not cancel before the trial ends, you will automatically be charged the monthly subscription price at the start of the first paid billing period. Trial eligibility is determined by Apple or Google - each Apple ID / Google Account may only receive one free trial.

The price displayed in the App at the time of purchase is always the price you will be charged. The price is loaded live from the App Store / Google Play and may differ by region and currency. $1.99 USD is the base indicative price; the binding price is always the one shown to you before confirming the purchase. Payment is charged to your App Store (iOS) or Google Play (Android) account at purchase confirmation.

Subskrypcja Pro zawiera 7-dniowy bezpłatny okres próbny dla nowych subskrybentów. Jeśli nie anulujesz przed końcem okresu próbnego, zostaniesz automatycznie obciążony miesięczną opłatą.

Cena subskrypcji wyświetlana jest w aplikacji przed zakupem. Płatność pobierana jest przez Apple lub Google.

6.3 Auto-Renewal / Automatyczne odnawianie

The subscription auto-renews monthly unless cancelled at least 24 hours before the renewal date. If a free trial applies, the first charge occurs at the end of the trial period; subsequent charges occur monthly. Renewal is charged within 24 hours before the end of each billing period.

Subskrypcja odnawia się automatycznie. W przypadku okresu próbnego pierwsze obciążenie następuje po jego zakończeniu. Możesz anulować na 24 godziny przed kolejnym odnowieniem.

6.4 Cancellation / Anulowanie

Cancel at any time in your store account settings:

• iOS: Settings → [Your Name] → Subscriptions → RepDrop Pro
• Android: Google Play → Profile → Payments & subscriptions → Subscriptions → RepDrop

You keep Pro access until the end of the current paid period. No partial refunds for unused time.

Po anulowaniu zachowujesz dostęp do Pro do końca opłaconego okresu.

6.5 Restore Purchases / Przywracanie zakupów

After reinstalling or switching devices, use "Restore Purchase" in the App to re-activate Pro at no extra charge.

07Right of Withdrawal - EU / Polish Consumers / Prawo odstąpienia (UE / Polska)

Under EU Directive 2011/83/EU, implemented in Poland by the Ustawa o prawach konsumenta (Dz.U. 2014 poz. 827), you normally have a 14-day right of withdrawal from a distance contract without giving any reason.

Exception for digital content: Once you confirm the purchase of RepDrop Pro and the Pro features are activated on your device, you explicitly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal, in accordance with Art. 38 pkt 13 of the Polish Consumer Rights Act and Art. 16(m) of EU Directive 2011/83/EU.

You will be clearly informed of this before completing the purchase.

Zgodnie z ustawą o prawach konsumenta przysługuje Ci prawo odstąpienia od umowy w ciągu 14 dni. Okres ten liczy się od daty zawarcia umowy (tj. od momentu rozpoczęcia okresu próbnego), a nie od pierwszego obciążenia. W przypadku treści cyfrowych dostarczanych natychmiastowo prawo to wygasa po aktywacji okresu próbnego na Twoje wyraźne żądanie. Jeśli anulujesz w trakcie okresu próbnego przed jego zakończeniem, nie zostaniesz obciążony żadną opłatą.

7.1 Refunds / Zwroty

After the withdrawal right expires, refunds are handled by the respective app store:

I am unable to issue refunds directly - all billing is managed by Apple or Google.

7.2 Complaints / Reklamacje

Polish and EU consumers may submit complaints to me by e-mail at hello@bypop.dev. I will respond within 14 days as required by Art. 7a of the Polish Consumer Rights Act.

Reklamacje przyjmuję na adres e-mail. Odpiszę w ciągu 14 dni. Możesz też skorzystać z platformy ODR UE lub Inspekcji Handlowej.

08Acceptable Use / Dozwolone użytkowanie

You agree not to:

• Reverse-engineer, decompile, or disassemble the App
• Attempt to bypass subscription verification
• Use the App for any unlawful purpose
• Redistribute or resell the App or any part of it

09Intellectual Property / Własność intelektualna

All content, code, graphics, and trademarks in the App belong to me or my licensors and are protected under Polish copyright law (Ustawa o prawie autorskim i prawach pokrewnych, Dz.U. 1994 nr 24 poz. 83) and EU Directive 2001/29/EC.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on your personal device(s) for personal, non-commercial purposes only.

Wszelkie prawa autorskie do aplikacji należą do mnie i są chronione polskim i unijnym prawem.

10Disclaimer of Warranties / Wyłączenie gwarancji

The App is provided "as is" and "as available" to the maximum extent permitted by applicable law. I do not guarantee the App will be uninterrupted or error-free.

EU / Polish consumers: These Terms do not limit your statutory rights under the Polish Consumer Rights Act or EU Directive 2019/770 on digital content contracts. If the App does not conform to the contract, you have statutory rights to remedy, price reduction, or termination.

Nie udzielam gwarancji ponad wymagane przepisami prawa. Konsumenci w Polsce i UE zachowują wszelkie prawa ustawowe wynikające z Dyrektywy 2019/770.

11Limitation of Liability / Ograniczenie odpowiedzialności

To the maximum extent permitted by law, my total liability for all claims arising from your use of the App shall not exceed the total amount you paid me in the 12 months before the claim arose.

This does not affect mandatory rights of consumers under Polish law, including liability for:

• Personal injury or death caused by negligence
• Fraud
• Any other liability that cannot be excluded under Polish or EU mandatory law

Moja odpowiedzialność jest ograniczona do wysokości opłat wniesionych przez użytkownika w ciągu 12 miesięcy. Nie wyłącza to praw konsumenta wynikających z prawa polskiego i unijnego.

12Changes to the Terms / Zmiany Regulaminu

I may update these Terms. Material changes will be communicated in the App before they take effect. Continued use after the effective date constitutes acceptance.

O istotnych zmianach Regulaminu poinformuję z wyprzedzeniem w aplikacji.

13Governing Law and Jurisdiction / Prawo właściwe i jurysdykcja

Poland and EU

These Terms are governed by Polish law. For disputes with consumers, the mandatory consumer protection rules of the consumer's country of residence apply (as required by EU Regulation 593/2008 - Rome I, and Regulation 1215/2012 - Brussels I). Polish consumers may bring proceedings before the courts of their place of residence.

Regulamin podlega prawu polskiemu. Konsumenci mogą dochodzić roszczeń przed sądem właściwym dla swojego miejsca zamieszkania.
